Terms and Conditions
Article 1 Definitions
The following definitions are used in this Agreement:
Buyer: The consumer or company that purchases a Ticket via Ticketpoint for an Event;
General Terms and Conditions: These General Terms and Conditions of Ticketpoint;
Booking: The conclusion of an agreement whereby the Buyer enters into an agreement with an Organizer of an Event in the manner set out in these General Terms and Conditions;
Entrance fees: The price of the ticket, excluding any additional costs or additional deliveries, such as, but not limited to, administration costs owed to Ticketpoint for the Booking;
Event: The event in which – by way of example, but not limited to – a performance is performed, including – but not limited to – a musical, theatre, stage or music performance, a concert, show or a sporting event for the benefit of which the ticket was purchased;
Location: The place where the Event is held;
Organizer: The party that organizes the Event and with whom the agreement is concluded upon purchase of the ticket;
Agreement: The relevant Agreement between the Organizer and the Buyer; Telephone Sales: The sale that takes place via the telephone number 0900-90008000 provided by Ticketpoint. This number may differ per Event;
Ticket: The admission ticket to an Event;
Ticketpoint: The private limited liability company Ticketpoint Nederland B.V., established at PO Box 2114, 5300 CC Zaltbommel
Website: The website www.ticketpoint.nl.
Article 2 General
2.1 These General Terms and Conditions apply to all services and offers that are performed or made through the intermediary of Ticketpoint, to every Booking for Tickets, by telephone, via the websites of Ticketpoint, and via retail sales. These General Terms and Conditions can only be deviated from in writing.
2.2 The General Terms and Conditions of the Organizer may also apply to the Agreement, which can be downloaded from its website in the relevant case. The location where the Event is held may apply house rules and/or codes of conduct, which can be downloaded from its website. By purchasing the Ticket, the Buyer also agrees to these conditions in advance.
Article 3 Establishment of Agreement
3.1 When offering and selling Tickets, Ticketpoint acts as the authorized representative of the Organizer for the purpose of establishing the Agreement between Buyer and Organizer. Ticketpoint is not a party to the Agreement that is established by purchasing a Ticket. The Agreement is established after Buyer has placed a Booking for one or more Tickets via Ticketpoint. Ticketpoint provides the admission tickets for the relevant event on behalf of Organizer. Ticketpoint sends Tickets to Buyer on behalf of Organizer.
3.2 Method of establishing the Agreement:
The Agreement is established as soon as Buyer has placed a Booking. Ticketpoint can unilaterally terminate the Agreement on behalf of Organizer, claim damages or claim performance, if Buyer fails to fulfill its obligations under the concluded agreement, at its sole discretion.
3.3 A Booking is irrevocable for Buyer. It is not possible for the Buyer to make changes to an agreement that has been concluded.
Article 4 Tickets
4.1 Tickets can be booked by a Buyer via the Ticketpoint Website or via Shop Sales, or by telephone via the telephone number indicated by Ticketpoint on its Website
4.2 The Tickets supplied by Ticketpoint are and remain the property of the Organiser and are made available to the Buyer by Ticketpoint.
4.3 Without prior written permission from the Organiser and/or Ticketpoint, it is not permitted to:
i. Sell the Tickets to third parties or provide the Tickets directly or indirectly to third parties in any other commercial manner;
ii. Offer the Tickets in commercial expressions – in any way whatsoever – or refer to the admission tickets in any other way;
4.4 If the Buyer acts in any way contrary to the General Terms and Conditions of Ticketpoint or the Organiser, Ticketpoint and/or the Organiser may invalidate the Tickets; holders of those Tickets will be denied access to the Event in the relevant case, without the right to compensation. 4.5 Ticketpoint and/or Organiser reserve the right to set a maximum number of Tickets to be booked. Bookings that exceed this maximum can be adjusted/cancelled without prior notice.
4.6 The prices for Tickets may be higher than the prices printed on the Tickets by Ticketpoint due to possible additional costs for, for example, reservation, payment and/or delivery. The statutory VAT rates apply.
4.7 The additional booking costs may differ based on the method and time of purchase. All costs are shown with the Booking. No other costs will be charged than the costs shown.
4.8 Tickets only provide access to the booked Event if the Ticket is provided with the control strip.
Article 5 Fulfillment
5.1 Ticketpoint aims to send the Tickets to the Buyer before the start of the Event, but at least 7 days before the start of the Event, provided that the purchase price for the Tickets has been paid. If the Tickets have not been received by the Buyer on time, the Buyer must contact Ticketpoint in writing (by letter or e-mail).
5.2 After receipt of the ordered Tickets, the Buyer must check them for correctness. If there are incorrectly printed Tickets, the Buyer will receive replacement Tickets at the first written request and without additional costs, on condition that the Buyer returns the already delivered tickets to Ticketpoint. Such a request must contain the relevant information and reasons. If the customer has not informed Ticketpoint in writing within 7 days before the start of the event, Ticketpoint may decide not to exchange the Tickets.
5.3 Ticketpoint reserves the right at all times to refuse Bookings from Buyers, or to impose additional conditions on Bookings.
Article 6 Liability
6.1 Ticketpoint cannot be considered as the Organizer of the Event and is not responsible for and does not provide any guarantee on the (artistic) quality and content of the Event and the course of events in or around the Location and accepts no liability on the basis of this fact.
6.2 If and to the extent that the Event is cancelled by the Organizer or the Location Holder, Ticketpoint will never independently refund Entrance Fees to the Buyer. It may occur that an Organizer requests Ticketpoint to refund, in which case Ticketpoint will again only act as an intermediary on behalf of the Organizer.
6.3 Ticketpoint can never be held liable for any damage to the Buyer as a result of death, injury, accidents, harm, loss, damage or theft prior to, during or as a result of a visit to the Event or the Location. 6.4 If and to the extent that Ticketpoint cannot meet its obligations towards the Buyer in whole or in part due to force majeure, the Buyer cannot derive any right to compensation from this.
6.5 Ticketpoint accepts no liability for loss or damage of Tickets by the Buyer for any reason whatsoever. In the event that Ticketpoint is requested by the Buyer to provide replacement Tickets, Ticketpoint is entitled to charge costs for this.
6.6 To the extent that Ticketpoint’s liability is excluded or limited, this also applies to the liability of Ticketpoint’s subordinates and/or assistants.
